Upgradation of pay structure of certain cadres

 

Ø RBE No. 155 /2022 No. PC-VII/2019/RSRP/3 dated 17/11/2022

Ø Upgradation of 35000 posts (50%) from Level-7 to Level-8 and further upgradation from Level-8 (50%) to Level-9 after 4 years service in Level-8.

Ø Financial Implication – 169.34 crore (approx.) which will be financially neutral after matching surrender of 5313 posts in Level-1 only all India level.

Ø Financial implication of Level-9 works out to be Rs.8.41 crore (approx.).

Ø Railway wise number of categories in GP 4200, 4600, 4800 & sanction strength as on 01.01.2014 to be taken.

Ø  Upgradation of 50% posts from Level-7 (PB-2/GP-4600)/Group ‘C* to Level-8 (PB-2/GP-4800)/Group *C’.

Ø Further upgradation of these 50% posts in Level-8 (PB-2/GP-4800)/Group ‘C’ to Level-9 (PB-2/GP-5400)/Group “C* on non-functional basis after 4 years of service in Level-8(PB-2/GP-4800).

Ø There are 46 categories which are to be upgraded.

Ø This upgradation will be effective from 01.12.2022.

Ø Sanctioned strength of cadre will be taken into consideration as on 30.11.2022.

Ø (i) Phase-I : On the cut-off date, in first phase, only 50% posts of the cadre strength to be upgraded from Level-7 (PB-2/GPA600) to Level-8 (PB-2/GP- 4800).

Ø (ii) Phase-II : Further upgradation of the 50% posts in Level-8 (PB-2/GP-4800) to Level-9 (PB-2/GP- 5400)/Group ‘C’ on non-functional basis after 4 years of service in Level-8(PB-2/GP-4800). After implementation of Phase-II, cadre structure of supervisory categories would be as under :

Ø In any case, after four years the total number of posts in Level-8 & Level-9 will not be more than 50% of the total cadre strength.

Ø Annual review of the Scheme to be taken on 1st July of every year.

Ø Financial Implications =(Pay Cell 1+Pay Cell 10 of Pay Level as per 7th CPC +DA)/2.

Ø (iii) After working out the financial implications, the matching savings shall be effected from posts in Level-1 of the concerned departments, before granting the benefit of upgradation to the cadre as per the revised percentage distribution of posts.

Ø (iv) If the Department/Railways are not able to provide the matching savings, the particular category/department will not be granted the benefit of upgradation till such time alternative solution is found with the approval of Board.

Ø (v) While effecting surrender of posts of equivalent financial value, the existing vacant posts available in the categories on the cut-off date shall also be considered.

Ø (vi) Details of posts so surrendered shall be intimated to Board invariably.

Ø There will be no change m the nomenclature/designation, duties and responsibilities and classification of the posts after upgradation and they will remain classified as Group ‘C’.

Ø Pay Fixation benefits as per extant Rules will be applicable.

Ø As such, the upgraded posts may be classified as Non selection.

Ø May be filled up on the basis of seniority, scrutiny of service records and Confidential Reports.

Ø Without holding any written tests and or viva voce.

Ø The extant practice being followed for promotion in level-7 in respect of Vigilance / D&A Clearance will be applicable for upgradation from Level-7 to Level-8 and Level-8 to Level-9 as per extant instructions.

Ø Reservation will apply as per extant rules.

Ø While determining the number of posts for upgradation, the permanent regular cadre strength of that particular category in Level-7 (excluding surplus & supernumerary posts).

Ø Counting of temporary posts for the purpose of determining the cadre strength, only those temporary posts which are in operation for at least three years may also be taken into account.

Ø Subject to certification that these posts are meant for regular activities which will continue and not for any sporadic requirements.

Ø These orders will not be applicable to ex-cadre work- charged posts.

Ø Since all the posts in three grades remain in Group ‘C’ and there is no change in designation, for the purpose of calculation of -vacancies for Direct Recruitment, the vacancies occurring in all three grades i.e. Level-7, Level-8, Level-9 (non-functional) will be taken altogether. However, Direct Recruitment will only be made in the grade of Level-7.

Ø Minimum residency period as per extant rules as prescribed for promotion to non selection posts would be applicable for up gradation to Level-8. Further probationers will not be eligible for the benefit of up gradation.

Ø Only the whole number may be taken for the purpose of granting upgradation.

Ø To illustrate further, if the cadre is of 675 posts, while granting the upgradation to 50% post the number comes to 337.5 posts. In this case the number of 337.5 may not be rounded off to 338 but the whole number of 337 may be taken into consideration for operating in the upgraded in the Level-8 and remaining 338 posts will be operated in Level-7.

Ø While calculating the matching savings, number of posts equivalent to the money value required, are required to be surrendered.

Ø To illustrate further, in case the number of posts is required to be surrendered is coming in fractions, if it is decided to surrender only 7 posts, the equivalent money value cannot be arrived at. Hence, the figure may be rounded off to 8 and the surplus value generated against surrender-of 8 posts may be transferred to the vacancy bank for future utilization.

Ø In this scenario, upgradation may be granted to the posts which are available for surrender. For granting the benefit of upgradation to the remaining posts, point 4(iv)(Annexure-II) under RBE No. 155/2022 may be referred to.

Ø Upgradations to Level-8 and further to Level-9 (non-functional) are to be reckoned for the purpose of MACPS. As every financial upgradation has to be counted and offset against the financial upgradation under MACPS in terms of extant instructions for regulation of MACPS.

Ø Upgradation is due to acute stagnation, even a single promotion  those directly recruited in Level-7.
