PASS RULES, 1986

In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following Rules, regulating, the issue of Passes and Privilege Ticket Orders to Railway servants, for travel by trains namely:-
1. Short Title, Commencement and Application: (1) These Rules may be called the Railway Servants (Pass) Rules, 1986.
(2) They shall come into force on the date of their publication in the Official Gazette.
(3) Except where specifically provided to the contrary they shall apply to all railway servants under the administrative control of the Ministry of Railways (Railway Board) but shall not apply to:—
(i) an apprentice engaged under the Apprentices Act;
(ii) a person in the casual employment or employed on daily wages ;
(iii) any person under the administrative control of the Ministry of Railways who by a general or special order is, excluded from the facilities of Pass or a Privilege Ticket Order under these rules.
2. Definitions : In these Rules, unless the context otherwise requires:—
(a) 'adopted child' means a child for whom there is satisfactory proof of adoption irrespective of the fact whether such adoption is permissible or not under the personal law governing the railway servant concerned.
(b) 'attendant’ means a person exclusively employed on salary in the personal service of a railway servant.
(c) 'dependent relative' in relation to a railway servant, whose father is not alive, means:-
(i) mother including a divorced mother;
(ii) unmarried or widowed sister;
(iii) brother/step-brother under twenty one years of age provided he resides with and is wholly dependent on the railway servant;
(iv) invalid brother of any age, and
(v) brother who has attained the age of twenty one years and is a bonafide student ot a recognised educational institution.
Provided that a person shall not be considered to be a dependent relative if his/her income from all sources including pension, dearness relief, etc. exceeds 15% of pay per month of the Railway servant or the amount arrived at by adding Rs.9000 to the dearness relief admissible to the pensioners/family pensioners on pension of Rs.9000/- and rounded off to the nearest ten rupees figure , whichever is more.
Provided further that a Pass or Privilege Ticket Order may be issued in favour of dependent relatives mentioned at (iv) and (v) only on production of a certificate from a Railway medical officer or the head of the recognised institution, as the case may be.
Provided further that dependent relatives may be included in the Privilege Passes/PTOs given to the railway servants in cases where father is missing for a period of at least 7 years Passes/PTOs can also be given to the sisters in similar circumstances. However, an affidavit as to the period since when the person is missing, duly attested by a Magistrate is necessary.
(d) 'family' includes:-
(i) spouse of a railway servant whether earning or not;
(ii) son or sons who have not attained the age of 21 years and are wholly dependent on the railway servant;
(iii) son or sons of the age of 21 and above who are;
(a) bonafide students of any recognised educational institution;
(b) engaged in any research work and do not get any scholarship/stipend;
(c) working as an articled clerk under the Chartered Accountant;
(d) invalid, on appropriate certificate from Railway Doctor;
(iv) unmarried daughters of any age whether earning or not;
(v) widowed daughters provided they are dependent on the railway servant;
(vi) legally divorced daughter who is dependent on the railway servant;
(e) the term "Guardian' need not necessarily be interpreted in its legal sense. It may mean an adult dependant relative or an adult member of the family; a paid nurse Governess or an attendant. When none of these are available a pass in favour of a Guardian, as admissible under these Rules, may be given to another person at General Manager’s, discretion.
(f) 'Pass' means an authority given by the Ministry of Railways or any railway administration to a person, authorising him to travel by rail gratuitously;
(g) 'privilege ticket order'(hereinafter referred to as P.T.O.) is an authority issued in favour of a railway servant which may be exchanged for a passenger rail ticket on payment of one third of the normal fare;
(h) 'railway servant' means a person who is a member of a service or who holds a post under the administrative control of Railway Board and includes a person who holds a post in the Railway Board. Persons lent from a service or post which is not under the administrative control of the Railway Board to a service or post which is under such administrative control do not come within the scope of this definition. This term excludes casual labour for whom special orders have been issued.
(i) 'recognised educational institution' for the purpose of these Rules means any school, college, university or institution recognised by the Government for imparting education or training in any discipline-general, technical, professional or military.
(j) 'pay' means the amount drawn monthly by a railway servant as
(i) basic pay
(ii) in the case of Running Staff, basic pay plus 30% thereof or any other percentage ot basic pay declared as pay from time to time:
(iii) any other pay which may be specially classified as pay by the President.
(k) (i) "Set" means one Pass or P.T.O for outward and return journeys :
(ii) "Half-set" means a Pass or P.T.O issued from one station to another.
(1) 'schedule' means the Schedule appended to these Rules.
(m) 'year' means a Calendar Year.
3. Officer or authority competent to issue and sign a Pass or PTO: A pass or PTO' may be issued by such officer or authority and may be signed by such officer as the Central Government (Ministry of Railways) may from time to time specify:
Provided that until such authorities or officers are specified, the Pass or PTO shall be signed and issued in accordance with the instruction/orders issued by the Central Government in the Ministry of Railways and in force at the commencement of these Rules.
4. Kinds of Passes: (1) A railway servant or the entitled members of his/her family and dependent relatives as defined in these Rules may be issued the following kind of passes, namely:
(i) duty pass;
(ii) privilege pass including passes while on deputation;
(iii) school pass;
(iv) post-retirement Complimentary pass;
(v) widow pass
(vi) residential card pass; and
(vii) special pass.
(2) The Passes specified in clause (i) of sub-rule (1) may be issued in the form of metal pass, a card pass or a cheque pass.
5. Duty Pass : (1) A railway servant may be issued a duty pass for performing journey on duty: and
(2) The category of railway servants, the circumstances and the conditions subject to which a duty pass may be issued under Rule 4(1 )(i) shall be specified in Schedule I.
6. Privilege Pass: (1) A railway servant may be issued on his/her request a privilege pass or a privilege ticket order in prescribed format (Annexure A) from one station to another as requested by him/her. Privilege Passes/P.T.Os are admissible for self, family, dependent relatives and adopted child, as defined in these Rules: and
(2) The category of railway servants, the circumstances and the conditions under which a pass under sub-rule(l) may be issued shall be as specified in Schedule II.
7. School Pass: (1) A school pass may be issued to the son or daughter of a railway servant who is a bona-fide student of any recognised educational institution; and
(2) The category of railway servants whose son or daughter may be issued a pass under sub-rule (1), the circumstances and the conditions subject to which such passes may be issued shall be as specified in Schedule III.
8. Post-retirement Pass: (1) a post-retirement complimentary pass may be issued to a railway servant after retirement or after he ceases to be a railway servant; and
(2) The category of railway servants, the circumstances and the conditions subject to which a pass under sub-rule(l) may be issued shall be as specified in Schedule IV.
9. Passes to widows of Railway Employees: (1) Passes may be issued to the widows of railway employees, who were in Railway service on or after 12.3.1987 and expired on or after that date whether after their retirement or during service and had opted for the scheme or were automatically governed under the scheme; and
(2) The circumstances and the conditions subject to which a pass under sub-rule (1) may be issued shall be as specified in Schedule V.
10. Residential Card Pass: (1) A residential card pass may be issued to a railway servant for performing rail journey from the place of residence to the place of his work.
(2) The category of railway servants, the circumstances and the conditions subject to which a pass under sub-rule (1) from any be issued shall be as specified in Schedule VI.
11. Special Pass: (1) A special pass may be issued to Railway servants, family members or dependent relatives as the case may be, on –
(a) medical grounds;
(b) sports account;
(c) for attending children camp or scouts camp;
(d) cultural functions; and
(e) on any other occasion which the Ministry of Railways or a Railway Administration deems fit.
(2) The circumstances and the conditions subject to which a pass under sub-rule(l) may be issued shall be as specified in Schedule VII.
12. Pass or P.T.O for non-railway servants : Notwithstanding anything contained in the foregoing rules, a pass or P.T.O. may be issued to a person who is not under the administrative control of the Ministry of Railways or the Railway Administration for such purpose and subject to such terms and conditions as may
be specified in the instructions issued by the Central Government (Ministry of Railways) from time to time in this behalf.
13. Loss/Misuse/Fraudulent use of Passes & Previlege Ticket Orders : Instructions given in Annexure 'B' may be followed for dealing with Loss/Misuse/Fraudulent use of Passes and P.T.Os.
14. Powers of General Managers to Condone Irregularities: G.Ms. are authorised to consider on merits and condone the irregularities in the cases enumerated in Annexure 'C'. These powers shall not be re-delegated to any lower authority.
15. Income tax/Monetary value of Passes and Privilege Ticket Orders: Monetary value of passes and privilege Ticket orders is not subject to income tax.
16. Status of Pass Manuals etc.: The provisions contained in Pass Manuals issued by the respective Railway or any other provisions on Passes contained in any other Manual/Rules etc. shall be valid provided it is not in contravention with the provisions laid down in these Rules.
17. Powers to Modify etc.: Powers to include, modify, amend or delete or relax any of the provisions contained in these Rules shall vest with the Ministry of Railways.
18. Removal of Doubts: If any doubt arises as to the interpretation of the provision of these rules, the same shall be referred to the Ministry of Railways for decision.
पास के समान्य नियम - रेल कर्मचारियों एवं उनके परिवार के सदस्यों को सुविधा के कारणों से, ड्यूटी के उद्देश्य से, अन्य विशेष अवसरों पर रेलों से यात्रा करने केलिए निःशुल्क अथवा रियायती दर सुविधा देने का प्रावधान है जो अनुशागी लाभ के रूप में प्रदान की जाती है। इन्हें रेल सेवा पास नियम के नाम से जाना जाता है।
- सामान्यतः सभी रेलकर्मचारियों को सुविधा पास सीधे रास्ते से ही प्रदान किए जाते हैं।
- किसी अन्य रास्ते द्वारा यात्रा के लिए दुरी का अन्तर 15 प्रतिशत से अधिक नहीं होना चाहिए।
- लम्बी दूरी एवं तेज रफ्तार से चलने वाली रेलगाड़ियों द्वारा यात्रा करने केलिए 15 प्रतिशत का अन्तर होना आवश्यक नहीं समझा गया है।
- सुविधा पासों को देने केमामले में यदि आश्रित को उस पास में सम्मिलित किया जाता है तो पाँच से अधिक परिवार के सदस्य नहीं हो सकते। लेकिन यदि आश्रित शामिल न हो तो परिवार केसदस्यों की संख्या पाँच से अधिक भी हो सकती है। अधिकतम दो आश्रितों को पास में सम्मिलित किया जा सकता है।
- पासों का किसी भी प्रकार का हस्तान्तरण करना वर्जित है, इसके लिए अनुशासनात्मक कार्यवाही की जाती है।
- एम.ए.सी.पी. योजना केतहत कर्मचारी को विततीय पदोंन्नति (ग्रेड) का लाभ प्रदान किया जाता है किन्तु उसे उच्च पद की प्रास्थिति प्रदान नहीं की जाती है। उदाहरणार्थ ग्रुप ‘डी’ को ग्रुप ‘सी’ नहीं मिलता है और ग्रुप ‘सी’ को ग्रुप ‘बी’ नहीं मिलता है। अतः पास के मामलों में विततीय सीमा के तहत द्वितीय से प्रथम श्रेणी पास तो अनुमेय हो सकता है किंतु अन्य लाभ जैसे पास की संख्या इत्यादि में इजाफा नहीं किया जाता है।
- पास-पी.टी.ओ. अब मार्ग के कालम में भारतीय रेल और कोंकण रेलवे पर उपलब्ध शब्द लिखा जाता है। प्रत्येक रेलवे का नाम लिखना आवश्यक नहीं है।
- प्रथम श्रेणी पास धारी द्वारा परिचर का आरक्षण कराने पर आरक्षण प्रभार देना होता है।
- कर्मचारी कलैण्डर वर्ष के सभी उपभोग कर चुका हो तो आरक्षण केउद्देश्य से उसे आवश्यकता पर 120 दिन पहले एक सैट पास/पी.टी.ओ. अगले वर्ष के खाते से दिये जाने का नियम है किंतु उस पर यात्रा 1 जनवरी या उसकेउपरांत ही की जा सकती है। यह सुविधा सेवा निवृत कर्मचारियों को भी प्रदान की गई है।
- चालू कलैण्डर वर्ष के पास/पी.टी.ओ. आगामी वर्ष में 30 अप्रैल तक क्रमशः जारी किये जा सकते है। जिनमें उपलब्धता तिथि 30 मई ही हो सकती है।
- गोल्डपास - यह पास चेयरमेन रेलवे बोर्ड, सदस्य रेलवे बोर्ड, महाप्रबन्धकों एवं उनकेसमकक्ष स्वतंत्र प्रभार वाले अधिकारियों को रेलवे बोर्ड द्वारा समस्त भारतीय रेलों पर परिवार के चार सदस्यों सहित प्रथम ‘ए.सी.’ श्रेणी में दो तथा शेष दो अन्य श्रेणी में ड्यूटी पर यात्रा करने केलिए अनुमति प्रदान करता है।
- सिल्वर पास - यह पास वरिष्ठ प्रशासनिक वेतनमान केसमस्त अधिकारियों को रेलवे बोर्ड द्वारा ड्यूटी पर समस्त भारतीय रेलों पर परिवार के कुल चार सदस्यों तक जिसमें प्रथम ‘ए.सी.’ श्रेणी में एक सदस्य तथा शेष सदस्य अन्य श्रेणी में यात्रा करने की अनुमति प्रदान करता है।
- ब्राँज पास - कनिष्ठ प्रशासनिक वेतनमान एवं उनकेनिचले पद के ग्रुप ‘बी’ अधिकारी वर्ग को ड्यूटी पर रहते हुए यात्रा करने के लिए महाप्रबन्धकों द्वारा उनकी क्षेत्रीय रेलों पर परिवार के कुल चार सदस्यों को द्वितीय वातानुकूल श्रेणी में यात्रा की अनुमति प्रदान करता है।
- ड्यूटी कार्ड पास - जिन कर्मचारियों को ड्यूटी पर कैलेण्डर महीने के दौरान अधिकतम समय कार्यस्थल से बाहर ड्यूटी पर रहना होता है, तो इस कारण उन्हें उनकी पात्रता श्रेणी के अनुसार ड्यूटी कार्ड पास प्रदान किए जाते हैं। ये ड्यूटी कार्ड पास निर्धारित सेक्शन, मंडलों अथवा क्षेत्रीय रेलों के लिए अथवा समज्ञत भारतीय रेलों पर यात्रा करने के लिए प्रशासनिक आवश्यकताओं को ध्यान में रखते हुए विभागाध्यक्ष की अनुमति से प्रदान किए जाते हैं। इन ड्यूटी कार्ड पासों का नवीनीकरण जारी करने की तारीख से एक वर्ष की अवधि के पश्चात किया जाता है। इन ड्यूटी कार्ड पासों केद्वारा कर्मचारी किसी भी समय किसी भी गाड़ी द्वारा (प्रतिबन्धित गाड़ियों को छोड़कर) ड्यूटी पर यात्रा कर सकते हैं।
- चैक ड्यूटी पास - जिन रेल कर्मचारियों को मुख्यालय से बाहर प्रशासनिक कारणों से कभी कभी यात्रा करनी होती है तो उन्हें ड्यूटी चेक पास अलग से बनाकर निर्धारित अवधि के लिए एवं पात्रता श्रेणी के अनुसार प्रदान किए जाते हैं।
- अन्य ड्यूटी पास - रेल कर्मचारियों को कुछ विशेष कारणों से जैसे - इंजन निरीक्षण, फुटप्लेट निरीक्षण इत्यादि के लिए इंजन एवं ब्रेकवान पास विभागीय सक्षम अधिकारी द्वारा अलग से प्रदान किए जाते हैं।
- जिन स्टेशनों पर पास की किताब उपलब्ध नहीं होती है एवं आकस्मिक प्रशासनिक कारणों से किसी भी कर्मचारी को बाहर ड्यूटी पर भेजना आवश्यक होता है तो उन्हें सरकारी नियमों /टेलीग्राम बुक पर आज्ञा प्रदान की जाती है जिसको वायर पास के नाम से जाना जाता है। इस प्रकार के पासों पर जारी करने वाले अधिकारी केहस्ताक्षर, तारीख, स्टेशन की मुहर एवं अधिकारी द्वारा दिए गए आदेश, संख्या का विवरण दिया जाएगा।
- उपनगरीय खंडों (सबरबन सेक्शन) में गैंगमैनों को किसी भी लोकल गाड़ी द्वारा ड्यूटी पर यात्रा करने के लिए बकल पास प्रदान किए जाते हैं, जिन्हें वह अपनी भुजाओं पर लगाए रखते हैं।
- पूरा सेट निःशुल्क सुविधा पास - जारी करने की तारीख से 5 महीने की अवधि तक
- आधा सेट निःशुल्क सुविधा पास - जारी करने की तारीख से 5 महीने की अवधि तक
- कर्मचारी की पत्नी/पति - चाहे वह रोजगार में हो अथवा नहीं
- पुत्र जिसकी आयु 21 वर्ष से कम हो तथा जो कर्मचारी पर पूरी तरह से आश्रित हो
- 21 वर्ष से अधिक आयु का पुत्र जो मान्यता प्राप्त शिक्षा संस्थान में अध्ययनरत हो।
- किसी भी आयु की अविवाहित पुत्री चाहे वह रोजगार में हो अथवा नहीं।
- विधवा पुत्री यदि कर्मचारी पर आश्रित हो।
- तलाकशुदा पुत्री यदि कर्मचारी पर आश्रित हो।
निम्नलिखित को आश्रित माना जा सकता है -
- माता, तलाक प्राप्त माता भी
- अविवाहित या विधवा बहन
- भाई या सौतेला भाई, 21 वर्ष से कम आयु और कर्मचारी के साथ रहते हुए आश्रित हो
- किसी भी आयु का विकलांग/अशक्त भाई
- भाई जो मान्यता प्राप्त शिक्षा संस्था का छात्र हो
- बहन जिसे कानूनी तलाक मिल गया हो और जो कर्मचारी के साथ रहते हुए आश्रित हो
मानार्थ पास -
- 20 वर्ष से अधिक सेवा अवधि होने पर 3 सेट
- 20 वर्ष से अधिक सेवा अवधि होने पर 2 सेट
- सेवा निवृत रेल कर्मचारियों को मानार्थ पास प्रदान किए जाते हैं, यदि उनकी मृत्यु सेवा निवृति के पश्चात हो जाए तो प्रत्येक केलेण्डर वर्ष के दौरान दिए जाने वाले मानार्थ पासों के ठीक आधे सेट उनकी विधवा/विधुर को दिए जाएंगे।
- दिनांक 12.3.1987 के पश्चात दो सेट पी.टी.ओ कम करने पर विधवा/विधुर पास की योजना लागू की गई है। इसके अन्तर्गत अब सभी रेल कर्मचारियों को प्रत्येक वर्ष 6 सेट पी.टी.ओ. के बजाय 4 सेट पी.टी.ओ. ही प्रदान करने का प्रावधान है।
- यह सुविधा उन कर्मचारियों की विधवा/विधुर को भी मिल सकेगी जो 12.3.1987 से पहले सेवा में थे किन्तु उन्हें पी.टी.ओ. के दो सेट के कल्पित मूल्य को एक मुश्त 250/- का भुगतान करना होगा। यह भुगतान मण्डल कैशियर द्वारा नकद या उस रेलवे से जहां विधवा पास लेना चाहती है, वि.स.एवं मु.ले.अधि. के नाम डीडी. द्वारा जमा कराया जा सकता है।
- उन कर्मचारियों की विधवा/विधुर जो कि इस योजना के प्रारम्भ होने के पूर्व ही गुजर गए थे, उनकी विधवा/विधुर को 250/- रु. रेलवे राजस्व में जमा करवा देने पर एवं उस मृतक कर्मचारी का मृत्यु प्रमाण पत्र, पी.पी.ओ. की प्रति एवं अन्य आवश्यक दस्तावेज प्रस्तुत कर देने पर विधवा/विधुर पास दिए जाने का प्रावधान है।
- सेवा निवृति या मृत्यु पर सेटलमेंट पास
- न्यायालय में हाजरी देने के लिए निलम्बित रेल कर्मचारियों को पास
- शारीरिक रूप से अपंग कर्मचारियों को परिचर सहित/उच्च श्रेणी सहित पास
- अर्द्ध रेल संस्थाओं के कर्मचारियों को पास - जैसे रेलवे इंस्टीट्यूट, काॅपरेटिव सोसायटी, प्रबन्ध समितियां इत्यादि ।
- अनुशासनिक कार्यवाहियों में जांच अधिकारी/बचाव सलाहकार को पास
- पहली नियुक्ति पर पास
- सांस्कृतिक कार्यक्रमों में भाग लेने के लिए पास
- हिन्दी सलाहकार समिति, रेल उपभोक्ता सलाहकार समिति, यात्री सुविधा समिति इत्यादि गैर रेल कर्मचारियों/संगठनों को पास
- पर्वतारोहण एवं लम्बी पैदल यात्रा अभियान दल में भाग लेने वाले कर्मचारियों को पास
- लाइसेंस कुलियों को मानार्थ पास
- कर्मचारी शिक्षा योजना के लिए पास
- कर्मचारी हित निधि द्वारा नियुक्त पूर्णकालिक होम्योपैथी/आयुर्वेदिक चिकित्सकों को मानार्थ पास
- अनुकम्पा के आधार पर बुलाए गए अभ्यार्थी को परीक्षा/ इन्टरव्यू के लिए पास
